These Terms and Conditions (the "Terms") apply to your use of goyachtbuddy.com (the "Site") and to any private yacht charter arranged through YACHTBUDDY L.L.C ("YachtBuddy", "we", "us"). By browsing the Site, requesting a quote or contacting us, you agree to these Terms. If you do not agree with them, please do not use the Site.
YachtBuddy is the trade name of YACHTBUDDY L.L.C, a limited liability company organized under the laws of the State of Florida, United States (Florida Division of Corporations document number L23000295494), with its principal place of business at 2415 NW 11 ST, Unit 30, Miami, FL 33125, United States.
YachtBuddy provides private yacht charter services in Miami, Miami Beach and Fort Lauderdale, Florida, United States.
1. What YachtBuddy Does
YachtBuddy arranges private yacht charters for individuals, families and groups. Each charter is carried out on a vessel operated by a licensed captain and crew. We help you choose a vessel and a schedule, we issue a written quote, and we coordinate the details of your day on the water.
We are not a public tour operator and we do not sell tickets for shared or scheduled excursions. Every booking is private.
2. Use of This Website
You may use the Site for lawful purposes only, to learn about our vessels and services and to request information or a quote. You agree not to interfere with the Site, attempt to gain unauthorized access to it, copy its content for commercial use, or use automated systems to extract data from it.
We may update, suspend or withdraw any part of the Site at any time without notice.
3. Quotes, Availability and Bookings
Information published on the Site, including vessel descriptions, photographs, capacities and indicative prices, is provided for general guidance and does not constitute a binding offer.
A charter is confirmed only when we have issued a written quote or confirmation for a specific date, vessel and duration, and you have accepted it and completed the payment required in that confirmation. Until then, availability is not held.
The written quote or confirmation you receive is the document that governs your charter. It sets out the vessel, the date, the departure time and duration, the number of guests, what is included, and the payment and cancellation conditions that apply to your booking. Where anything in that document differs from these Terms, that document prevails.
4. Payments
Payment methods, deposit amounts and payment deadlines are stated in your written quote or confirmation. Prices are quoted in United States dollars unless stated otherwise. Unless expressly included in your confirmation, taxes, dockage fees, fuel surcharges, gratuities, food and beverages, water toys and any other extras are not included.
5. Changes, Cancellations and Weather
The cancellation and rescheduling conditions that apply to your booking are those stated in your written quote or confirmation. Please read that document before you pay.
Safety comes first. If the captain determines that weather, sea conditions, mechanical issues or any other circumstance makes it unsafe or unlawful to sail, the charter may be shortened, rerouted, rescheduled or cancelled. The captain has sole and final authority over the vessel, the route, and the decision to depart or return. In these cases we will offer you the alternatives described in your confirmation.
6. Safety, Conduct and Capacity
Guests must follow the instructions of the captain and crew at all times. The maximum number of guests stated in your confirmation may not be exceeded under any circumstance, as it is set by law and by the vessel insurance.
Minors must be accompanied by a parent or legal guardian. Illegal substances are not permitted on board. The captain may refuse boarding to, or disembark, any guest whose conduct puts the safety of the vessel or of other guests at risk, without a refund.
Guests are responsible for any damage they cause to the vessel or its equipment.
7. Vessels, Captains and Operators
Charters are performed on vessels operated by licensed and insured captains. Where a vessel is owned or operated by a third party, that operator is responsible for the operation of the vessel and for the services carried out on board, in accordance with its own licences, insurance and operating rules.
We select the vessels we present with care, but a specific vessel cannot be guaranteed. If the vessel confirmed for your charter becomes unavailable for reasons beyond our control, we will offer a comparable vessel or the alternatives set out in your confirmation.
8. Accuracy of Information
We take reasonable care to keep the Site accurate and up to date. Even so, descriptions, photographs, availability and prices may change, and errors may occur. Photographs are illustrative and may not correspond exactly to the vessel assigned to your charter.
9. Intellectual Property
The YachtBuddy name and logo, the design of the Site, and its text, photographs, video and graphics are protected by intellectual property rights and belong to YachtBuddy or to its licensors. You may not reproduce, distribute or use them commercially without our prior written permission.
10. Privacy and Your Information
This section explains how we handle the information you share with us through the Site.
What we collect. We collect only the information you choose to give us: your name, your email address, your phone number, and the details of the charter you are interested in, such as the date, the number of guests and the occasion. Where a booking requires it, we may also collect the information needed to meet safety and identification requirements on board.
Why we collect it. We use your information to answer your enquiry, prepare and send your quote, coordinate your charter, and keep you informed about your booking. If you have agreed to receive them, we may also send you occasional updates about our services. You can ask us to stop at any time.
Who we share it with. We share your information only with the people who need it to deliver your charter, such as the captain, the crew or the vessel operator, and with the service providers that support our operation, such as our website host, our email provider and our payment processor. We do not sell your information and we do not share it for third-party advertising.
How long we keep it. We keep your information for as long as it is needed to serve you and to meet our legal, accounting and insurance obligations, and then we delete it or anonymise it.
Your choices. You may ask us at any time to access, correct or delete the information we hold about you, or to stop contacting you. Write to us using the details in the Contact section and we will respond within a reasonable time.
Security. We use reasonable technical and organisational measures to protect your information. No website or transmission over the internet can be guaranteed to be completely secure, and we cannot warrant absolute security.
Children. The Site is not directed to children under 13, and we do not knowingly collect their information.
11. Cookies and Analytics
The Site uses cookies and similar technologies so that it works correctly, remembers your preferences and helps us understand how visitors use it. Some of these are set by third-party services such as web analytics and translation tools. You can block or delete cookies in your browser settings, although some parts of the Site may then not work as intended.
12. Communications by WhatsApp, Phone and Email
When you contact us through WhatsApp, by telephone or by email, we receive and keep the content of that conversation so that we can attend to your request and coordinate your charter. WhatsApp is a third-party service governed by its own terms and privacy policy, which we do not control.
13. Third-Party Links and Services
The Site may contain links to third-party websites and tools. We provide them for convenience and we are not responsible for their content, their practices or their privacy policies.
14. Limitation of Liability
Boating involves inherent risks. To the fullest extent permitted by law, YachtBuddy is not liable for indirect, incidental or consequential damages arising out of the use of the Site or of any charter, including loss of enjoyment, missed connections, or personal items lost or damaged on board. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Guests take part in the charter at their own risk and are responsible for informing the captain of any medical condition, allergy, pregnancy or mobility limitation that may affect their safety on board.
15. Indemnity
You agree to hold YachtBuddy harmless from any claim, loss or expense arising out of your breach of these Terms, your breach of the instructions of the captain and crew, or any damage caused by you or by a guest in your party.
16. Changes to These Terms
We may update these Terms from time to time. The version published on this page is the one in force, and the date shown at the top indicates when it was last revised. Changes do not affect charters already confirmed in writing before the change.
17. European Union and United Kingdom Customers
If you are a consumer resident in the European Union or the United Kingdom, the following applies in addition to the rest of these Terms. Nothing in this section limits any right you may have under the mandatory consumer law of your country of residence.
Information before you book. Before you make any payment, we confirm to you in writing (by email or WhatsApp) the vessel, the date, the departure time and duration, the departure location, the maximum number of guests, the total price and what is included and not included. That written confirmation, together with these Terms and our Cancellation Policy, forms the agreement between us.
No 14-day withdrawal right for dated services. A private yacht charter is a leisure service provided on a specific date. Under Article 16(l) of Directive 2011/83/EU and under regulation 28(1)(h) of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day right of withdrawal does not apply to contracts for leisure services that are to be performed on a specific date or period. Your cancellation and refund rights are therefore the ones set out in our Cancellation Policy, which you accept when you confirm your booking.
Your data. For visitors in the European Union and the United Kingdom, YACHTBUDDY L.L.C acts as the controller of the personal data you provide through this Site. You have the right to access, correct, delete, restrict or object to the processing of your personal data, and the right to receive a copy of it in a portable format. Where our processing is based on your consent, you may withdraw that consent at any time. To exercise any of these rights, contact us at info@goyachtbuddy.com. You also have the right to lodge a complaint with the supervisory authority of your country of residence, or with the Information Commissioners Office in the United Kingdom. Please note that we transfer and store your data in the United States, where our business operates.
Disputes. If you are not satisfied with how we have handled a complaint, you may use the European Commissions online dispute resolution platform. Nothing in these Terms deprives you of the right to bring proceedings in the courts of your country of residence where the law of that country gives you that right.
18. Governing Law
These Terms are governed by the laws of the State of Florida, United States, and any dispute relating to them or to the Site will be subject to the courts of Miami-Dade County, Florida, without prejudice to any right you may have under the mandatory law of your country of residence.
