This Privacy Policy explains what personal information we collect when you use goyachtbuddy.com (the “Site”) or book a private yacht charter with us, why we collect it, who we share it with and what control you have over it.
1. Who We Are
YachtBuddy is the trade name of YACHTBUDDY L.L.C, a limited liability company organized under the laws of the State of Florida, United States (Florida Division of Corporations document number L23000295494), with its principal place of business at 2415 NW 11 ST, Unit 30, Miami, FL 33125, United States. We are the party responsible for the personal information described in this policy.
You can reach us at any time at info@goyachtbuddy.com or at +1 786-554-5056.
2. What Information We Collect
Information you give us. Your name, email address, phone or WhatsApp number, the date and time you are interested in, the number of guests in your group, the vessel you are asking about, the occasion you are celebrating, and anything else you choose to write to us in a message.
Information we need in order to sail. Before departure we may ask for the names of the guests on board, and whether any guest is a minor, because vessel capacity and safety rules depend on it. If a marina or a captain requires identification, that check is performed by them, not by us.
Payment information. We do not collect, see or store your card number. Payments are processed by our payment provider, and we only receive confirmation that a payment succeeded, together with the amount, the date and the last digits of the card.
Technical information. When you browse the Site we automatically receive your IP address, device and browser type, the pages you visit, and the site or advertisement that referred you. This comes from cookies and similar technologies (see section 7).
3. Why We Use It
We use your information to answer your enquiry and send you a quote; to arrange, confirm and operate your charter; to take payment and issue receipts; to contact you before departure about timing, weather or the meeting point; to keep records required by tax, accounting and liability rules; to protect the safety of guests, crew and vessels; and, only if you have asked for it, to send you occasional offers.
We do not sell your personal information, and we do not share it with third parties for their own marketing.
4. Communications by WhatsApp, Phone and Email
Most of our conversations happen over WhatsApp, phone or email because that is what our guests prefer. When you write to us on WhatsApp you are also subject to WhatsApp own privacy terms, over which we have no control. We keep the conversation because it is the written record of what was agreed about your booking. If you ask us to stop contacting you for commercial reasons, we will, but we will still contact you about a charter you have already booked.
5. Payments
Card payments are handled by Stripe, a payment processor certified under PCI DSS. Your card details are entered directly into Stripe systems and never reach our servers. Stripe processes that data as an independent controller under its own privacy policy, and may use it to prevent fraud.
6. Cookies and Analytics
The Site uses cookies that are necessary for it to work, together with analytics and advertising cookies that help us understand how visitors find us and which pages lead to a booking. These include services provided by Google. You can manage or refuse non-essential cookies through the consent banner shown when you first visit the Site, and you can delete cookies at any time in your browser settings. Refusing analytics and advertising cookies does not prevent you from browsing the Site or requesting a quote.
7. Who We Share It With
We share only what is necessary, and only with: the captain and the vessel owner or operator for the charter you have booked, so that they can prepare the boat and comply with safety rules; our payment processor; the providers that host our website, send our emails and run our analytics; and any authority, marina or insurer where the law or a safety incident requires it. All of them act on our instructions or under their own legal obligations, and none of them are authorised to use your information for their own marketing.
8. Where Your Information Is Stored
We operate in Miami, Florida, and your information is stored and processed in the United States. If you are writing to us from outside the United States, you should understand that your information will be transferred there and that United States privacy law may differ from the law of your country. Where we are required to protect that transfer by contract, we use the safeguards our providers make available for this purpose.
9. How Long We Keep It
If you asked for a quote and did not book, we keep your enquiry only as long as it is useful to follow up on it, and then delete it. If you booked a charter, we keep the booking record, the payment record and the written confirmation for as long as required by the tax, accounting and liability rules that apply to us in Florida and under United States federal law, and then delete them. Marketing consents are kept until you withdraw them.
10. Your Rights
You may ask us to show you the personal information we hold about you, to correct it if it is wrong, to delete it, to restrict how we use it, to object to a particular use, or to send it to you in a portable format. Where we rely on your consent, you may withdraw it at any time. Write to info@goyachtbuddy.com and we will respond within a reasonable period. We may need to confirm your identity before acting, and we may have to keep records that the law requires us to keep even after a deletion request.
11. European Union and United Kingdom Visitors
If you are located in the European Union or the United Kingdom, YACHTBUDDY L.L.C acts as the controller of your personal data under the GDPR and the UK GDPR. Our legal bases are: the performance of a contract with you, for everything related to a booking you have made or asked for; our legitimate interest in operating and improving the Site and in preventing fraud; your consent, for analytics and advertising cookies and for any marketing message; and compliance with a legal obligation, for accounting and safety records. In addition to the rights in section 10, you have the right to lodge a complaint with the supervisory authority of your country of residence, or with the Information Commissioners Office in the United Kingdom.
12. Children
The Site is not directed at children and we do not knowingly collect information from anyone under 16 through it. Minors may of course be guests on a charter, but their details are given to us by the adult who makes the booking and are used only for capacity and safety purposes. If you believe a child has given us information directly, write to us and we will delete it.
13. Security
The Site runs over an encrypted connection, access to our booking records is limited to the people who need it to operate a charter, and payment data never touches our systems. No method of transmission over the internet is completely secure, so we cannot promise absolute security, but we do take these measures seriously and review them.
14. Changes to This Policy
If we change this policy we will update the date at the top of this page. If the change is significant and affects a booking you have made, we will tell you directly.
15. Contact Us
For any question about this policy or about your personal information, please contact us.
